Since banks follow the UCC, your undated check will be deposited. It’s important to resist the urge to jot the date down yourself, even if you think it won’t be detected. If you have access to the person who wrote the check, you can always return to that person and ask that the date be written in.

What if there is no date on a check?

No Date. There isn’t anything in the Uniform Commercial Code saying a check has to be dated. If you receive an undated check you can fill in the date yourself. You can then cash it or deposit it as long as the check writer signed it and properly filled out the amount and the payee line.

What happens if you forget to date a check?

According to the code, a personal check becomes “stale dated” six months after you write it. Banks don’t have to dishonor stale dated checks, but the Uniform Commercial Code gives a bank the option of refusing these checks. Legally, banks can honor post dated checks at any time regardless of the date on the item.

Do banks look at dates on checks?

That’s because once a check is signed it becomes legal tender, and, according to the Consumer Financial Protection Bureau, banks and credit unions can generally use their own discretion when deciding when to process a check – all without regard to the check’s printed date.

Can a check be deposited before the Date shown on the check?

The date you choose to use is not part of a legally binding agreement between you and the payee. In most cases, the recipient can deposit the check at any time. Unless you set things up correctly with your bank, the bank is free to pay funds out of your account before the date shown on your check.

Can a check be cashed 90 days after a void date?

Many checks have notices on them such as “void 90 days after check date.”. The “void by” date may or not be enforceable. If a company has specifically instructed a bank to abide by the “void by” date, the bank may refuse to endorse the check after the void date. Otherwise, it likely will cash the check up until six months from the date recorded.

Is the ” void by ” date on a personal check enforceable?

The “void by” date may or not be enforceable. If a company has specifically instructed a bank to abide by the “void by” date, the bank may refuse to endorse the check after the void date. Otherwise, it likely will cash the check up until six months from the date recorded.

Do you have to notify your bank of a post dated check?

You are also required to notify your bank that a check is post dated stating the date of the check, check number, payee, and amount. The rules (or lack of them) do lead to tough calls and they really emphasize the need for communication between the payer and payee when dealing with post-dated checks.
