A creditor, like a credit card company, armed with a court judgment has more options than an unsecured creditor under state law. While a lien converts the underlying debt to a secured debt, there are other better options available to a judgment creditor.

Can a judgment proof debtor collect on a debt?

Creditors can’t obtain money or property from a debtor who is judgment proof and a judgment-proof debtor might not need to file for bankruptcy. If you don’t have funds or property that a creditor can reach, a creditor can’t collect its debt.

Can a judgment creditor attach a claim to a property?

After the procedure, the creditor must file another motion in court. Only then will they be able to attach a claim to the debtor’s assets or properties that are not exempted by the state. When mentioning ‘property,’ most people (perhaps including you) think only of real estate.

Can a judgment creditor take my car away?

Remember, not all third party debt collectors obey federal laws like the Fair Debt Collection Practices Act (FDCPA). If the collection efforts of the original creditor and any third-party debt collectors fail, the creditor will initiate legal action.
