As long as a debt has not been paid or canceled, there’s no statute of limitations on when a lender has to submit a 1099-C. If the lender files a 1099-C with the IRS, however, they have until Jan. 31 to have it in your mailbox. You can receive a Form 1099-C on an old debt at any time.

Can a debt collector issue a 1099-C?

The tax code requires the creditor to issue an IRS Form 1099-C, which notifies the debtor that the debt has been canceled or forgiven. The debtor is then obligated to include the amount of the canceled debt as income and pay appropriate taxes (note that the debtor may have defenses to this tax obligation).

How can I get a copy of my 1099-C?

First, try contacting the financial institution that settled the debt. If that doesn’t work, you can request a wage and income transcript for the tax year in question from the IRS. You can request it online or by calling 800-908-9946.

When does a creditor have to file a 1099-C?

If the creditor files a 1099-C with the IRS, then typically it must provide you with a copy by January 31 so you have it for tax filing purposes that year. This is similar to the rule for W-2s from employers. However, there is no rule for how long a creditor can carry debt on its books before it decides it’s uncollectible.

Can a 1099-C be a substitute for bankruptcy?

Even bankruptcy, which I only recommend as a very last resort, resolves a person’s debts instead of leaving them hanging. Getting a Form 1099-C is not a substitute for decisively resolving a debt. At this point, you can contact your bank and try to get them to report the balance as zero.

Can a 1099-C debt balance be zero?

That’s not an easy question to answer. The Internal Revenue Service does not say that your debt balance is zero after a Form 1099-C is issued, or even that the bank cannot try to collect after the notice is sent. A Form 1099-C is an informational form sent by the creditor to the IRS, with a copy sent to you.

What’s the code on the 1099 C form?

Box 6 on the 1099-C form should have a code to help you determine why you received the form. You can also learn more about 1099-C cancellation of debt processes and the reasons you might receive such a form if you’re not sure whether yours is accurate.
